Acceptance

By creating an account or using KybaBox, you agree to these Terms of Service. If you do not agree, do not use the service.

Eligibility

You must be at least 18 years old and have the legal capacity to enter into a binding contract in your jurisdiction to use KybaBox. By using the service, you represent that you meet these requirements.

Geographic Restrictions

You may not use the service if you are located in, or a resident or citizen of, a country or territory subject to U.S. economic sanctions or embargoes (including, without limitation, those administered by the U.S. Office of Foreign Assets Control). By using the service, you represent that you are not located in, and are not a resident or citizen of, any such country or territory. We may restrict or terminate access for users in sanctioned jurisdictions.

Data Processing for EEA/UK/Switzerland Users

If you are located in the European Economic Area, United Kingdom, or Switzerland, your personal data (including photos) is processed and stored in the United States. By using the service, you acknowledge this transfer. We implement appropriate safeguards as described in our Privacy Policy. You have the right to request deletion of your data at any time.

Account Terms

You are responsible for:

  • Providing accurate account information
  • Keeping your password secure
  • All activity that occurs under your account

Your Content

You retain ownership of the content you create (box data, photos, etc.). By using KybaBox, you grant us a license to store, process, and display your content as needed to operate the service. We do not claim ownership of your data. Do not use the service for regulated, critical, or highly sensitive data as described in the Prohibited and Unsuitable Use Cases section.

Intellectual Property Rights

All rights, title, and interest in and to the KybaBox mobile and web applications, including but not limited to the source code, graphical user interface, designs, text, images, logos, and "look and feel" of the service, are the exclusive property of KybaBox, LLC. These materials are protected by copyright, trademark, and other intellectual property laws of the United States and international treaties.

Trademarks. KybaBox™, the KybaBox logo™, and all related names, logos, and slogans are trademarks of KybaBox, LLC. You may not use such marks without the prior written permission of KybaBox, LLC. All other names, logos, and product names on this Service are the trademarks of their respective owners.

Limited License to Users. Subject to your compliance with these Terms, KybaBox, LLC grants you a non-exclusive, non-transferable, revocable license to access and use the application solely for your personal, non-commercial use. You may not copy, modify, distribute, sell, or lease any part of our services or included software, nor may you reverse engineer or attempt to extract the source code of that software.

Acceptable Use

You agree not to use KybaBox to:

  • Violate any laws or regulations
  • Infringe on others' intellectual property or privacy
  • Transmit malware or attempt to compromise the service
  • Abuse, harass, or harm others

We may suspend or terminate accounts that violate these terms.

Prohibited and Unsuitable Use Cases

KybaBox is designed for personal or light business use to organize moving boxes and storage. It is not intended for, and you must not use it for, critical, regulated, or highly sensitive data, including:

  • Healthcare or medical records (including data subject to HIPAA or similar health privacy laws)
  • Government, military, or classified information
  • Financial data requiring special compliance (e.g., payment card data subject to PCI-DSS)
  • Legal privilege or confidential legal matters
  • Data that by law or contract must remain in a specific jurisdiction or not be transferred internationally
  • Personal data of third parties that you are not legally permitted to process or transfer
  • Any data requiring industry-specific certifications (e.g., HIPAA, FedRAMP, SOC 2 for regulated industries)

Your data is stored in the United States. We do not offer data residency guarantees, industry-specific compliance certifications, or the safeguards required for the use cases above. By using the service, you represent that your use does not involve such data and that you will not upload or store it. For such use cases, please use a service designed with appropriate safeguards and certifications.

We may suspend or terminate accounts that violate this section, without refund of any prepaid fees.

AI Features

When AI Mode is enabled, KybaBox uses AI to suggest box contents, titles, and rooms from your photos and voice. These suggestions are provided "as is" and may be inaccurate. You are responsible for reviewing and correcting any AI-generated content before saving.

Service Availability

KybaBox is provided "as is" and "as available." We do not guarantee uninterrupted access. We may modify, suspend, or discontinue the service with reasonable notice when possible.

Subscription Expiry and Data Retention

When your subscription expires, you will lose access to the app. We retain your account and box data for 30 days to allow you to renew and regain access. After 30 days, we permanently delete your data. You may request earlier deletion at any time.

Termination

You may stop using KybaBox at any time. We may suspend or terminate your account for violations of these terms or for other reasons. Upon termination, your right to use the service ends. We may retain data as required by law or for legitimate business purposes.

Indemnification

You agree to indemnify, defend, and hold harmless KybaBox and its operators from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the service, your violation of these terms, or your violation of any third-party rights, including claims arising from your storage of prohibited or regulated data.

Limitation of Liability

To the maximum extent permitted by law, KybaBox and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or revenue arising from your use of the service. Our total liability shall not exceed the amount you paid for the service in the twelve months preceding the claim.

Dispute Resolution

These terms are governed by the laws of the United States. Any disputes shall be resolved in the courts of the applicable jurisdiction. You agree to attempt informal resolution before pursuing legal action.

Changes

We may update these terms from time to time. We will notify you of material changes by posting the updated terms and updating the "Last updated" date. Continued use of the service after changes constitutes acceptance of the new terms.
